Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the PinSnap mobile application (the "Service") operated by PinSnap ("we", "us", or "our").

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the Service.

1. Subscription and Payments

1.1 Subscription Service

PinSnap offers auto-renewable subscription plans through Apple's In-App Purchase system:

• Annual Subscription: Full access to all features for one year
• Free Trial: Limited-time trial period for new users (where available)

1.2 Billing and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions by going to your account settings on the App Store after purchase
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

1.3 Refunds

All purchases and subscriptions are processed by Apple. Refund requests must be submitted directly to Apple through your purchase history. We do not handle refunds directly.

2. Use License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes, subject to these Terms.

2.1 Restrictions

You agree not to:

• Modify, reverse engineer, decompile, or disassemble the app
• Attempt to gain unauthorized access to the Service or its related systems
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers connected to the Service
• Share, transfer, or sublicense your account or access credentials
• Use automated systems to access the Service without our permission

3. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of PinSnap and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of PinSnap.

4. Hardware Requirements

You acknowledge that:

• PinSnap is designed to work with specific Sony camera models that support Bluetooth GPS functionality
• We do not guarantee compatibility with all Sony camera models
• Camera firmware updates may affect compatibility
• Hardware defects or limitations of your camera are outside our control

5. Disclaimer of Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

• The Service will function uninterrupted, secure, or available at any particular time or location
• Any errors or defects will be corrected
• The Service is free of viruses or other harmful components
• The results of using the Service will meet your requirements
• GPS accuracy will meet your specific needs

6. Limitation of Liability

IN NO EVENT SHALL PINSNAP, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content
• Loss of GPS data or geotagging information
• Camera hardware failures or incompatibility issues

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

7. Indemnification

You agree to defend, indemnify, and hold harmless PinSnap and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

• Your use and access of the Service
• Your violation of any term of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right
• Any claim that your use of the Service caused damage to a third party

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

If you wish to terminate your account, you may simply discontinue using the Service. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which can be found at https://pinsnap.aurorabounce.com/privacy.html. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

12. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by PinSnap. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that PinSnap shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
